Quarter of a Million Dollar Recovery For Cyclist Who Struck a Road Defect In Brooklyn

This month we obtained a 225,000.00 settlement for young Brooklyn cyclist who sustained a severe shoulder fracture who struck an open and unfinished Con Ed vault installation.

The cyclist who was turning onto adjoining street struck a unfinished edging of a Con Ed vault that the sub-contractor failed to properly restore. The New York City Administrative Code requires restoration of street openings as well the requirement to maintain the surrounding area flush and level. In this case, the subcontractor hired by Con Ed failed to properly secure the site at the end of the day and complete proper paving. They also failed to post proper warnings or signage to allow the cyclist to be aware of the defect.

The matter was settled before trial in the Supreme Court, Brooklyn.
