On Dec. 20, 2011, the plaintiff was operating a Vespa motor scooter westbound on West Broadway at the intersection of Mill Road and West Broadway in Hewlett when he became involved in a motor vehicle collision. He claimed a sedan being driven by Cole Levine made a left hand turn from the right hand lane of West Broadway to proceed Northbound on Mill Road striking him. He was thrown from his Vespa. Plaintiff claimed injuries to his abdominal, left kidney and spleen.

Plaintiff sued Levine claiming he was negligent in the operation of his vehicle. He also named the vehicle's owner Louis Levine claiming he was vicariously liable of the driver's actions. Plaintiff also named Burt Greenburg, who was also making a left hand turn in his sedan onto Mill Road from West Broadway in the left turn lane. He claimed Greenburg contributed to the collision. Levine conceded negligence. Prior to trial, the action against Greenburg was dismissed via motion for summary judgment.

Plaintiff was taken by ambulance to a local emergency room with complaints of abdominal pain. He sustained a left kidney laceration, splenic laceration, open abdominal wound, and left colon tear and required a splenectomy. Plaintiff also underwent a left nephrectomy to address kidney laceration and a VAC dressing and mesh implantation to address open abdominal wound.He also underwent a small bowel decompression and small bowel resection and reconstruction of the abdominal wall.

RESULT

A settlement was reached just prior to trial in the Supreme Court, Nassau County, New York for $ 2,900,000.00 that will net over 3 million Dollars in total.
