MARBLEHEAD — A Marblehead doctor is suing an area paving company, claiming negligence in warning the public of a Nahant roadway's conditions, which led him to crash his bike, according to complaint filed in Salem Superior Court.

Dr. Edgar Robertson, of 10 Westminster Road in Marblehead, suffered a broken hip that required surgery after he lost control of his bicycle as he hit a patch of unpaved road, which he said wasn't visible because it lay just over the crest of a hill, according to the complaint filed by Salem attorney Walter Costello Tuesday.

Aggregate Industries was responsible for "certain milling, paving and related work" on Castle Road near the intersection of Flash Road in Nahant in August 2010, and neglected to post warning signs when it allowed public to use the roadway in an unfinished condition, according to the complaint.

Robertson is seeking full compensation, interest and costs in the suit, according to the complaint. Aggregate Industries' Northeast region is headquartered at 1715 Broadway in Saugus.
